Dutko has more than 20 years of experience handling high-stakes litigation against powerful defendants. He has tried more than 50 jury trials and recovered hundreds of millions of dollars for clients through verdicts and settlements. His practice focuses on catastrophic injury, wrongful death, and complex litigation.
Dutko served as lead trial counsel in West v. Colorado Materials, representing the parents of an oilfield worker killed by a tractor-trailer. Following the week-long trial in Hays County, Texas, the jury returned a $46 million verdict for the family, the largest personal injury verdict in Hays County history. Dutko also gained notoriety as a top national trial attorney while representing the family of Tyler Skaggs in a lengthy civil trial in Southern California over the drug overdose death of the MLB Pitcher. Following the trial, the family and Los Angeles Angels reached a confidential settlement with the family expressing gratitude for the efforts of Dutko in a statement.
Before joining Kherkher Garcia, Dutko spent eight years at Rusty Hardin & Associates where he served as Managing Partner and Head of Personal Injury Litigation. Earlier in his career, he represented insurance companies and large corporations on the defense side, giving him firsthand insight into the strategies defendants and insurers may use to limit liability and reduce recoveries.
Dutko has been licensed in Texas since 2006. He earned his undergraduate degree from Texas A&M University and his law degree from South Texas College of Law Houston, where he was named Dean’s Most Outstanding Student Advocate and inducted into the Order of the Barristers. He later served as an adjunct professor at South Texas College of Law, teaching trial advocacy and coaching trial teams to national championships.
His work has earned recognition from Lawdragon, Best Lawyers in America, and Super Lawyers. Lawdragon recognized Dutko among the “500 Leading Lawyers in America” in 2025 and 2026 and among the “500 Leading Litigators in America” in 2026.
