Venice, Florida – Hale Law Partner Rose Kasweck has secured a $2,050,000 settlement for a Venice car accident victim after a distracted driver rear-ended the client’s vehicle at an intersection. The Venice rear-end collision settlement follows an initial insurer offer of $125,000.
The crash happened as the client approached an intersection in Venice behind a line of approximately five to six vehicles stopped at a red light. When the light turned green, traffic had not yet started moving, and the client rolled to a stop behind the vehicles ahead while preparing to accelerate.
At that moment, a distracted driver struck the rear of the client’s vehicle at approximately 45 mph. The at-fault driver never applied the brakes and was reportedly using a cell phone at the time of the crash, and law enforcement cited the driver. Hale Law is not releasing the names of the client or the at-fault driver.
The settlement is substantially higher than the insurer’s opening figure. Early offers in injury claims often arrive before anyone has documented the full cost of an injury, including future medical care and lost income.
For that reason, Hale Law encourages crash victims to review any initial settlement offer with a lawyer before accepting it, since signing a release generally ends the claim.
The case reflects a risk that plays out in stop-and-go traffic across Southwest Florida. When a light changes, drivers in a line of stopped cars do not all move at once, and a driver looking at a phone instead of the road may not notice that the vehicles ahead are still stationary.
Florida law addresses both sides of that problem. Section 316.0895 of the Florida Statutes provides that a driver shall not follow another vehicle more closely than is reasonable and prudent. Separately, the Florida Ban on Texting While Driving Law prohibits manually typing into, or reading messages on, a wireless device while driving, with limited exceptions such as when the vehicle is stationary.
Rear-end collisions are sometimes dismissed as minor, but a driver stopped in traffic has little ability to avoid a vehicle approaching from behind at speed. In these claims, the harder questions often involve what the crash is worth rather than who caused it, as insurers scrutinize medical treatment, future care needs, and whether an injury is permanent.
Hale Law represents people injured in rear-end collision claims and distracted driving crashes throughout Venice and Sarasota County. Under Florida law, most negligence claims must be filed within two years of the injury, although different deadlines can apply in some situations.
Evidence can disappear even sooner. Phone records, vehicle data, and surveillance video from nearby businesses are easier to secure in the days after a crash than months later.
