Effective January 1, 2026, the Centers for Medicare & Medicaid Services (CMS) permanently revised its definition of direct supervision through the Calendar Year 2026 Medicare Physician Fee Schedule. The new framework allows qualified physicians or practitioners to meet immediate availability requirements using real-time, two-way audiovisual technology, eliminating the need for physical presence in the office suite.
Under the pre-2026 framework, direct supervision required physicians to remain onsite and ready to intervene. According to ContrastConnect, this posed challenges for smaller and rural practices, where limited physician availability and rotating coverage could restrict scheduling and access to supervised services.
With the updated rule, imaging facilities—including those in rural or underserved areas—can use remote audiovisual supervision to satisfy CMS requirements for qualifying services, without requiring a practitioner to be physically present at each location. The approach preserves the supervision standard while offering facilities more flexibility.
The framework applies to diagnostic tests governed by 42 CFR §410.32, eligible incident-to services, and certain pulmonary and cardiac rehabilitation programs, as outlined in the guide. However, services associated with 010 or 090 global surgery periods remain excluded from the virtual supervision option.
ContrastConnect emphasizes that remote supervision requires a simultaneous, real-time audio and video connection between the supervising practitioner and the facility; audio-only connections do not meet CMS requirements. The chosen technology and protocols must also comply with privacy and security standards, including HIPAA and HITECH.
If the audiovisual connection is lost and cannot be restored, the practitioner no longer meets the immediate availability requirement. The guide recommends that facilities plan for possible connection failures and maintain records documenting the supervising practitioner, their availability, and the technology used during each service.
